Service Agreement

Applicable to all tiers — terms vary by tier as noted below.

1. Parties

This Service Agreement (“Agreement”) is entered into between Tahoe Hosting Co. LLC (“Manager”) and the property owner (“Owner”) for the management of the vacation rental property identified in the agreement (“Property”).

2. Service Scope

Manager agrees to provide vacation rental management services as outlined in the selected service tier (Cohost, Full Management, or Premium). Specific services included in each tier are detailed in the Schedule of Services & Fees below.

3. Term & Renewal

  • Cohost: Month-to-month. No minimum commitment.
  • Full Management: 6-month initial term, then month-to-month.
  • Premium: 12-month initial term, then month-to-month.

After the initial term, agreement automatically renews month-to-month unless either party provides 30 days written notice.

4. Compensation

Manager receives a percentage of gross booking revenue (before platform fees) as compensation for services rendered:

  • Cohost: 10–15% of gross revenue
  • Full Management: 20–25% of gross revenue
  • Premium: 25–30% of gross revenue

The exact percentage is set during onboarding based on property type, location, and expected revenue. Setup fees are non-refundable and due upon agreement signing.

5. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination, Manager will honor all existing reservations through their checkout date. Owner is responsible for management fees on all reservations booked during the term. No early termination penalties.

6. Owner's Right of Use

Owner may block dates for personal use at any time via the property management system or by written request. Blocked dates are not subject to management fees. Owner agrees to provide reasonable notice (14+ days recommended) to avoid conflicts with pending bookings.

7. Exclusivity

  • Cohost: Non-exclusive. Owner retains control of their listing.
  • Full Management & Premium: Exclusive management during the term. Owner agrees not to list the property on any platform independently while the agreement is active.

8. Insurance Requirements

Owner must maintain a minimum $1,000,000 general liability insurance policy covering short-term rental activity for the duration of this agreement. Owner shall provide proof of insurance upon request.

9. Permitting

Owner is responsible for obtaining and maintaining all required permits, including the City of South Lake Tahoe VHR permit and TOT registration. Manager will assist with permit processing as an add-on service or as included in the Premium tier.

10. Tax Remittance

Manager will collect and remit Transient Occupancy Tax (TOT) and Tourism Improvement District (TID) fees on behalf of Owner as required by the City of South Lake Tahoe. Currently 12% TOT + $5.50/night TID.

11. Guest Damage Protection

Manager provides insurance-backed guest damage protection through Truvi (formerly Superhog), covering accidental and intentional guest damage up to $1,000,000 per incident. Protection is active on every booking at no additional cost to Owner. Claims are handled by Truvi's dedicated resolutions team — no chasing guests for payment. Normal wear and tear and pre-existing conditions are not covered. Owner must maintain their own property and liability insurance separately.

12. Indemnification

Each party agrees to indemnify the other against claims arising from their own negligence or willful misconduct. Manager is not liable for guest injuries, property damage beyond normal wear, or acts of nature.

13. Dispute Resolution

Any disputes arising under this agreement shall first be addressed through good-faith mediation. If mediation fails, disputes shall be resolved by binding arbitration in El Dorado County, California.

LLC operates under California Business & Professions Code Section 10131.01(a), which exempts managers of transient occupancies (30 days or fewer) from real estate broker licensing requirements.
